In this context, the objectives were in particular:<\/p>\n<ol>\n<li>the creation and increase of cybersecurity capabilities within the EU;<\/li>\n<li>the mitigation of the risks to which networks and information systems in critical sectors are exposed;<\/li>\n<li>guaranteeing the continuity of essential services after an incident has occurred;<\/li>\n<li>creating a framework to facilitate collaboration and cooperation between Member States within the EU.<\/li>\n<\/ol>\n<p>Directive (EU) 2022\/2555 of the European Parliament and of the Council of 14 December 2022 on measures for a high common level of cybersecurity across the Union, amending Regulation (EU) No 910\/2014 and Directive (EU) 2018\/1972, and repealing Directive (EU) 2016\/1148 (NIS 2 Directive) (hereinafter, the \u2018NIS 2 Directive\u2019) seeks to make necessary improvements to NIS 1 in the face of the changing cyberthreat landscape and aims to limit the divergences in the transposition of NIS 1 identified by the various Member States. Overall, the new features of NIS 2 are as follows:<\/p>\n<ol>\n<li>definition of standard criteria to determine the entities that fall by default within the scope of this directive;<\/li>\n<li>introduction of new sectors within the scope, grouping them into the categories \u2018important\u2019 and \u2018essential\u2019;<\/li>\n<li>risk management measures are to be applied to all information networks and systems that support the entity&#8217;s activities, not just those that support essential services;<\/li>\n<li>Liability of management bodies of entities falling within the scope of the NIS 2 Directive for infringements of the rules;<\/li>\n<li>harmonisation of the security measures to be applied (establishing security policies, ensuring security in the supply chain, etc.);<\/li>\n<li>clarification of the rules on the notification of incidents by entities to the competent authority;<\/li>\n<li>introduction of catalogues of the supervisory and enforcement powers of the competent authorities, as well as maximum thresholds for sanctions for violations of the provisions of the NIS 2 Directive.<\/li>\n<\/ol>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t<details id=\"e-n-accordion-item-2581\" class=\"e-n-accordion-item\" >\n\t\t\t\t<summary class=\"e-n-accordion-item-title\" data-accordion-index=\"2\" tabindex=\"-1\" aria-expanded=\"false\" aria-controls=\"e-n-accordion-item-2581\" >\n\t\t\t\t\t<span class='e-n-accordion-item-title-header'><div class=\"e-n-accordion-item-title-text\"> The NIS 2 Directive states that the provisions of this Directive must be transposed in the Member States by 17 October 2024 at the latest. They must apply them from 18 October 2024. These dates relate to the adoption of a law transposing the NIS 2 Directive (hereinafter the \u2018NIS 2 Law\u2019) at national level.<\/p>\n<p>After the entry into force of the NIS 2 Law, the ILR will have to update or, if necessary, prepare its regulations for the sectors for which the ILR will be the competent authority. The entities will be informed and consulted on this matter. Entities will have to analyse their situations individually and, where necessary, comply with the obligations arising from the NIS 2 Directive.<\/p>\n<p>&nbsp;<\/p>\n<p>Furthermore, the NIS 2 Directive requires the ILR to draw up a list of essential and important entities, as well as entities providing domain name registration services, by 17 April 2025 at the latest. In order for the ILR to achieve this objective, and in accordance with Article 3(4) of the NIS 2 Directive, entities falling within the scope of the NIS 2 Directive are obliged to submit all the information requested via the self-registration form available on the ILR website.<\/p>\n<p>&nbsp;<\/p>\n<p>Upon receipt of the self-registration form, the ILR will review and confirm the status of the entity in question (i.e. status as an essential or important entity). The ILR may request additional information from the entity in question to process or complete the file.
